Washington, D.C. (January 24, 2025) – Today, the United States Court of Appeals for the District of Columbia issued its decision in CAA et al. v. FDA. The decision, published today, resolved the question of whether the FDA’s authority to regulate premium cigars would be reinstated. In a unanimous decision, the Court upheld the earlier removal of the FDA’s regulatory authority. The opinion held that “the final Rule’s deficiencies [were] serious” and struck the FDA’s regulatory authority over premium cigars.
In addition to upholding the lower court’s decision removing FDA’s regulatory authority, the court has remanded the case for further proceedings to establish a clear and appropriate definition of premium cigars while the question of retroactive user fees was not resolved. The Court’s decision did recognize the FDA’s continued ability to re-start the rule-making process which could result in the re-regulation of premium cigars in the future.
Cigar Rights of America is currently reviewing the court’s decision and will provide a comprehensive analysis in the coming days. CRA remains committed to protecting the interests of premium cigar consumers, retailers, and manufacturers while continuing to advocate for a fair and reasonable regulatory framework.
“We are encouraged by the court’s acknowledgment that the FDA’s previous approach to regulating premium cigars was fundamentally flawed, and we are deeply grateful for this favorable ruling. This decision underscores the critical need for a clear and appropriate federal definition of premium cigars to ensure future regulations accurately reflect their unique characteristics.” said Mike Copperman, Executive Director of Cigar Rights of America.
Further updates and insights will be provided as we analyze the implications of the court's ruling and determine the appropriate next steps for the industry.
We need an end to the nanny state. It's not their job or any of their business whether we're harming ourselves or not. We know tobacco is bad for us. We like it and we don't care.

Yeah it’s amazing how they preach that nicotine is so bad for us. Tobacco is always the target. Funny how the same people never mention the levels of nicotine that are in such healthy foods as tomatoes, eggplant, zucchini, or celery.

Same people who demonize cigars push for weed. Keep the people intoxicated, easier to control.

I figure there's a time and a place for everything God gives. Freedom means free people. It also means those people exercising responsibility and having respect for the freedoms of others, which means compromise.
By now everyone knows that weed was made illegal in order to preserve the profits that had been lost when alcohol prohibition was repealed. It was bizarre to me that people would legitimize one natural product over another. Each has its own inherent risks and rewards, which responsible people should recognize and respect. Don't blow your smoke in the restaurant, don't get baked and go to work, drive, etc.
It seems like common sense, to me. But, I'm weird, so, there's that.

Most CAO's strike me as one-note wonders. A lot of them are good, but they are so straight forward that I get bored of them about half way through.
At any given time the urge to sing "In The Jungle" is just a whim away... A whim away... A whim away...

Unfortunately, many states still ban it thinking the ban will actually do something beneficial.

Amazing we can't get half the tobacco from Watch City that California can get.
Guys please help out @Vision with some aromatics from WCC. Pretty obvious dry beg for tobacco. He’s low.
A good cigar and whiskey solve most problems.
What do you need, @vision Pete?
Nothing. Unlike "Dry Beg Jeff", the Sensei of the Dry Beg, I never said I wanted to get it. Just a statement of fact.
@OutdoorsSmoke_21191 And that's how you retort.
Wow. Now DBJ has another meaning…🤪

While some regulations are good. Joe shouldn’t be able to make vape in his garage with the stuff he has laying around and sale it to teenagers.
Most of them seem overly invasive based on someone else’s opinion.
We need more common sense in this country.

people 'on the spectrum' often rely on nicotine to improve executive function.

In Missouri, after two years, tax collections are 3x the estimates. Must be working.
Don't let the wife know what you spend on guns, ammo or cigars.
