There will likely be a thriving underground response to this if the enforcement is draconian. The other downside for CA of this is that an underground response would cut down revenue to the state from tobacco tax. It is a bad idea for everyone.

Hey, that looks like fun. Damned if you do (pay the fee to sell), damned if you don't. That fee is the same reason my wife and I stopped operating our LLC here. The Franchise Tax Board wants their cut for us to operate. I feel like there's a word for it, that isn't "taxation."
