I was shocked to see hauled out Tiger, all Oxy'd up on the TV giving an interview before the trophy presentation. His face was red, eyes glazed up, slurring words and what does he go and do...plows off a cliff. I think he finally learned his DWI lesson sadly.

I had to think on this awhile. I was conflicted. While it's true that the thieves were stealing a portion of the car-owners life, the time and effort that was put into earning the money, it seems terrible that they lose their life over "just a car". However, calling this a "death penalty"? It seems wrong terminology. While there is actually a history of imposed penalties like this, eg. steal a horse? get hanged, to call this "death penalty" seems improper.

Did the officer, off-duty or not, give notice to the perpetrators of the crime? In other words, did he state clearly "Stop or I'll shoot."?
If so, was the message received, or could have been reasonably expected to have been received by the perpetrators of the crime? It makes a difference whether or not they were outside the vehicle and should have heard the warning, or were inside already, assuming they were driving it away and not loading it on a roll-off truck.
If they were able to hear the warning, and chose NOT to cease and desist, then I feel bad for their families, and for the officer whose hand they forced with their actions. They made a choice to die rather than to give up their ill-gotten prize.
Suicide by cop would be a more appropriate description than death penalty for stealing a car.
On the other hand is the question of when is use of deadly force appropriate? Was the officer in fear of his own life? Were they pointing a weapon at him?

Interesting. It does seem that his use of force was likely inappropriate. I must say that I disagree with Maryland's "Duty to retreat" stance, though. Sounds like a good way to get cornered and killed. I graduated High School in Texas, and much prefer the "Stand your ground" approach to defending oneself.
